Application Process
All liquor licenses are issued by the State of Tennessee Alcoholic Beverage Commission (TABC) located in Nashville. You must apply to the City of La Vergne for a Certificate of Compliance and or a Certificate of Good Moral Character before you can go to the TABC for their approval.

The entire process of getting a Certificate of Compliance and/or a Certificate of Good Moral Character can take up to 4-6 weeks, depending on when you submit your application. The Certificate of Compliance (Retail Liquor Store) has to be approved by the Board of Mayor and Aldermen. They meet on the first Tuesday of every month beginning at 7 p.m.  The Certificate of Good Moral Character (Liquor By The Drink) is also approved by the Board of Mayor and Aldermen.  The Certificate of Compliance for Liquor By The Drink is approved by the Public Works Director to ensure all location requirements have been met.
 
Making application to sell or serve alcohol in La Vergne requires several steps. First an applicant must provide information to the city that includes (but not limited to):
  • Name, birthdate, address
  • Number of years living in state
  • Occupation and duration
  • Felony convictions in last 10 years
  • Employers name and address
  • Business partner (if applicable) and same information for partner(s)
  • If corporation, names, birth dates and addresses of all officers and directors
  • Proposed location of business
  • The amount of money invested or to be invested and the source of funds to be used, and, if borrowed, the name of the person or bank from whom borrowed

Retail Liquor Stores
Each application for a certificate of compliance for off-premise consumption shall pay a non-refundable application fee of $250. The applicant must complete and return with the application any documents or forms that the chief of police or city attorney may require in order to conduct an investigation on the applicant.

You must have a site already picked out before you submit an application. If you do not own the property, you must submit an agreement between yourself and the property owner that states you can use that building/property for a liquor store. We must know where you are going to put the store so we can make sure you meet the distance regulations.

When an application is received, the City Recorder's Office will forward a copy of your application to the Chief of Police and City Attorney to make sure all of the requirements have been met.  A sign will be posted at the site of the retail location for a minimum of 10 days prior to the City Council meeting stating the applicant's intent to seek a license from the Tennessee Alcoholic Beverage Commission.

You must attend the Mayor / Aldermen Workshop and Meeting so that you can answer any questions that may arise. During the Regular Monthly Meeting, the Board will consider your application. If approval is given, the City Recorder's Office will compile the information you need to submit to the TABC. This could take a few days.

Additional steps are required through the Tennessee Alcoholic Beverage Commission.

Liquor By The Drink
Each application for a Certificate of Good Moral Character and a Certificate of Compliance shall pay a non-refundable application fee of $250. Certificate of Good Moral Character

The Certificate of Good Moral Character must be approved by the Board of Mayor and Aldermen. They meet on the first Tuesday of every month at 7 p.m. They will consider each application that comes before that board after an investigation has been completed on the Applicant. Basically the Certificate ensures that the applicant does not have a criminal background and that the Board feels that the applicant will abide by all State and Local laws regarding the selling of Liquor.

Certificate of Compliance
The Certificate of Compliance must be approved by the Public Works Director. This Certificate ensures that the location of the Restaurant, Hotel, etc. meets all distance regulations, zoning regulations and other requirements listed in the Municipal Code.

Regulations for the sale of Liquor By The Drink can be found on the Tennessee Alcoholic Beverage Commission website. The city may issue a Certificate of Good Moral Character if the background check is clear.  The Certificate of Compliance may be issued by the city if all location requirements are met.

Each year, a privilege tax for the sale of Liquor By The Drink must be paid by January 1.  The privilege tax is based upon the type of permit and the number of seats or rooms located in the business.
